Glasses purchased from specdepot will be governed by the following terms and conditions.

These terms and conditions do not affect your statutory rights.
Customer Obligations.
By submitting your order for glasses you confirm:
- 1.1 You are over 16, not registered blind or partially sighted.
- 1.2 You have a prescription dated within the last two years, one year if you are 70 or over. The prescription must be signed and dated by a medically qualified practioner.
- 1.3 If you are sending your existing glasses to read your prescription, you are confirming they have been made to your current prescription and is in date as per the terms of clause 1.2
- 1.4 By entering your prescription, you are confirming it is below 8 sphere or 4 cyl. Orders over this cannot be guaranteed, prices are available on request
- 1.5 It is your responsibility to provide full and accurate details of your prescription. Specdepot cannot be held responsible for any mistakes given.
- 1.6 If you cannot provide your pd, specdepot will use an appropriate or average pd of 63mm/60mm for smaller frames. Reduced by 2mm, for reading glasses.
- 1.7 Goods are for your own personal use and shall not be used for re sale or for any other purpose.
Description and supply of Goods
- 2.1 Specdepot will endeavour to supply goods exactly as shown on the website. It maybe due to circumstances beyond our control there could be slight variations. If the frame selected is not available, an alternative or refund can be selected. If no reply is received, specdepot at its discretion may provide a replacement or cancel the order.
- 2.2 Specdepot can change, withdraw or add any frame to the website at any time and without prior notice.
- 2.3 There will be no contract with specdepot until we approve your order and accept your order. Once accepted, you may not cancel your order.
- 2.4 Specdepot on the advise of it’s dispensing opticians have total discretion as to whether to accept an order or not.
- 2.5 If deemed necessary, specdepot can contact yourself or optician for further information, request a copy of your prescription or request you obtain a new prescription to fulfil your order.
- 2.6 Specdepot has absolute right to refuse an order without limitation
Prices, Payment, Delivery
- 3.1 All prices exclude postage. Current postage prices are displayed on the website. Prices for glasses include vat, all prices are in pounds sterling.
- 3.2 Whilst specdepot endeavour to guarantee all prices, prices are subject and can be changed at any time. Some prescriptions that require special lenses, maybe subject to additional charges.
- 3.3 Payment in full is required at time of ordering.
- 3.4 Delivery is guaranteed within a maximum 28 days, most orders will be delivered under 7 days. Certain specialist lenses can take slightly longer.
- 3.5 If delivery has not been received after 28 days, you must notify specdepot. This information will be checked and alternative arrangements made.
- 3.6 If a delivery is not accepted, it may be necessary to charge an additional fee to cover costs for a second delivery.
- 3.7 Upon delivery, the goods must be inspected to check for damage, goods do not match your order or visual impairments. You must contact specdepot immediately to inform us of any problems.
- 3.8 If the goods are faulty or damaged, specdepot must be notified within 48 hours. After this time an exchange may only be possible. The goods must be returned within 7 days to receive a refund or exchange.
- 3.9 You are responsible for returning glasses back to specdepot. Contact customer services within 48 hours to obtain a returns number.
- 4.0 Transfer of title and risk – the goods shall pass to you upon delivery and full payment has been received by specdepot.
Guarantees
- 4.1 Nothing in this contract excludes or limits our liability to you for death or personal injury caused as a result of our negligence or any breach of the statutory implied terms as to title of goods or for fraud or any other liability which, by law we are not allowed to limit or exclude. Maximum liability to you in connection with any physical damage caused to your property through our negligence will not under any circumstance exceed £5000.
- 4.2 The maximum liability to specdepot for all claims arising out of or in connection to an order will be no more that the total sums received for the goods.
- 4.3 Specdepot (inc agents, subcontractors and employees)under no circumstances will be liable to you for any business interruption, loss of data, loss of use, loss of profits, contracts, goodwill or anticipated savings.
- 4.4 Specdepot will not be liable for any loss or damage resulting from amy inaccurate, misleading information that results in any loss or damage.
- 4.5 Specdepot cannot be liable for failure to comply with these terms and conditions owing to any act or event beyond its control, inc acts of god, natural disasters, war, disease or any other act deemed beyond its control.
General
- 5.1 The terms and conditions set out herein take precedence over previous statements or agreements (verbal or written) in respect of merchandise and service. Any wording contained in our website or any other communication is given as guidance only.. It does not form part of a contract.
- 5.2 All Merchandise is sold subject to availability.
- 5.3 Headings are for convenience only and not for interpretation.
- 5.4 These terms and conditions are governed by English law and hereby submit to the exclusive jurisdiction of the English courts in relation to any dispute arising out of them.
